General

These general terms and conditions apply to all equipment rentals by Festi SRL, Chaussée de Boondael 152‑154, 1050 Ixelles, BCE no. 0462.688.812. They are also available at www.festi.be. Unless explicitly agreed otherwise in writing, the customer’s general terms are considered void if they conflict. By placing an order, the customer acknowledges having read and unconditionally accepted these terms.

Price

Rental prices are shown on www.festi.be and are in EURO excluding 21 % VAT. Festi reserves the right to change prices at any time; the price in effect at the time of ordering applies. Prices are valid for a three-business-day period, including pickup/delivery day and return day. After that, a quote will be required. If rented items are not returned by the contractual deadline, the rental will automatically renew for successive equivalent periods. Festi may terminate the contract by notifying the customer that it will retrieve the items at the end of the current period.

Transport & Delivery

The customer may choose to collect and/or return rented items themselves—in such cases unloading, transport, and (dis)assembly are at the customer’s risk and expense. All pickups and returns must be on business days during Festi’s opening hours. Festi can also deliver and/or collect for an additional fee. The customer must receive the items at the agreed place and time; otherwise Festi may return the goods to its premises at the customer’s cost. The customer must ensure items are ready for loading. Any additional trip will be charged. The delivery / pickup fee includes 15 minutes for unloading and 15 minutes for loading (per person). Extra services are charged per the terms on www.festi.be. Festi disclaims liability for delivery delays due to loss, equipment failure, strikes, etc.

Rented Items

Festi commits to fulfill orders subject to stock availability. Items are deemed delivered in perfect condition and correct quantity per delivery note. Items may only be used with the accessories provided by Festi. Festi retains ownership at all times, including in event of renter’s insolvency. Modifications are prohibited.

Return of Rented Items

Items must be returned in the condition received and with original packaging. Any item not returned, damaged, or unfit for use—including by theft, fire, or other cause—will be charged at replacement cost plus 15 %. Inventory and quality control is done at Festi’s warehouse. The renter may request joint control by email before end of rental. Otherwise Festi’s assessment is considered accepted. Costs for joint control will be charged if items comply with the delivery note.

Payment Terms

Unless agreed otherwise, the rental price must be prepaid at pickup or delivery at Festi’s headquarters. The cost includes (i) rental fee per Article 2, (ii) transport/delivery cost per Article 3, and (iii) a deposit of at least € 200. If payment isn’t made in full, Festi may withhold item delivery. In case of breach or termination, Festi reserves the right to retain the deposit without prejudice to any additional damage compensation. Orders changed less than 48 hrs before delivery may incur additional charges. Invoices are payable in cash. A € 5.50 administrative fee (excluding VAT) applies to each invoice. Complaints must be made by registered letter within 10 days of invoice date; otherwise invoices are deemed accepted. Late payments automatically incur 10.5 % monthly interest and a fixed indemnity of 15 % (minimum € 125).

Liability

The renter acknowledges being informed of safety rules for setup and use. Festi disclaims all liability for accidents. The renter is responsible for theft, damage, or destruction of rented items. It is the client’s responsibility to obtain appropriate insurance.

Cancellation

If canceled between 5 and 3 business days before delivery, a penalty of 50 % of the invoice applies. If canceled less than 3 days before, the full amount is due (excluding transport costs). Non-use of items doesn’t exempt the customer from payment.

Personal Data Processing

When requesting a quote or concluding a contract, Festi processes personal data to perform the contract. Data Controller: Festi SRL (see article 1). Purpose: sale and rental of equipment and informational communication. Legal basis: contract. Categories of data: identification (company, address, phone, email, contact person) and financial (bank details, debts, transactions). For details, see our Data Protection Policy on festi.be.

Jurisdiction & Applicable Law

Belgian law applies. Only the Justice of the Peace of the 1st Canton of Brussels, the Court of First Instance of Brussels, or the Brussels Commercial Court have jurisdiction for disputes relating to rental contracts with Festi.
